Vitaclaris Terms of Use

Effective October 28, 2026

Some features described here arrive with version 1.5 of the app, such as Simple view, shared family profiles, doctor links and visit recordings. Until you update, they don't apply to you.

1. Agreement

These terms are an agreement between you and Julio Hartstein, the developer of Vitaclaris (formerly Vitaspan) ("we", "us"), about your use of the Vitaclaris app, its AI features, sync and Vitaclaris Plus. By agreeing in the app, or by using it, you accept these terms and the Privacy Policy. If you don't agree, don't use the app.

You get Vitaclaris from Apple's App Store or TestFlight, so Apple's Licensed Application End User License Agreement (the "Apple EULA") also applies: it's your license to use the app, and it covers warranties and liability. These terms add to it; if they conflict, the Apple EULA applies. Purchases are also governed by Apple's Media Services Terms and Conditions.

2. Not medical advice

Vitaclaris helps you keep your health information in one place and prepare for your appointments. It isn't a medical device and doesn't provide medical advice, diagnosis or treatment.

What its AI features produce, whether Claude writes it or Apple Intelligence on your device, such as answers in Ask, readings of your documents, summaries of recorded visits, explanations and insights in the app's screens, plans and suggested questions for your doctor, is generated automatically from the information you provide. It can be incomplete or wrong. Use it as something to discuss with your doctor, not as a decision: don't start, stop or change a medication, treatment, diet or exercise program because of it without talking to your doctor first, and never ignore or delay medical advice because of it.

Some features have limits of their own:

  • A visit's summary is a draft: check it against what you heard before you save it, and ask your doctor when something isn't clear.
  • Blood age and Heart risk are research estimates from published formulas (PhenoAge and PREVENT, with their sources in the app). They can be off for you, they aren't a diagnosis, and they're for talking with your doctor.
  • Labs to ask for lists the tests that published guidelines suggest for someone with your information, with their sources. It's a list to talk over with your doctor, who decides which tests you need.
  • The blood pressure and glucose programs help you measure, follow your readings over time and share them with your doctor. They don't diagnose high blood pressure or diabetes. Their targets are the ones your doctor gave you or common ranges you choose.
  • Simple view's lines about your readings (such as a week's blood pressure average against a target) come from published guidelines, with their sources. They're not a diagnosis, and one reading is never judged on its own.
  • The women's health and bone health programs help you keep track of symptoms and prepare questions and screenings to talk about with your doctor. They don't diagnose, don't predict fertility and aren't a method of contraception, and they don't calculate a fracture risk.
  • Reminders, missed-dose follow-ups and alerts to family can be late or not show, for example when a device is off, in a Focus or out of battery. Don't rely on them alone for a medication that must be taken on time; an alert to family doesn't replace checking on the person. Refill reminders are estimates from the counts you enter, and asking for a refill is up to you.
  • "I'm OK today" isn't an emergency service or a way to watch over someone's safety: a check-in can be late or not arrive, and nobody is told when there isn't one. In an emergency, call your local emergency number.

Vitaclaris and its AI features are there to support your doctors and other health professionals, not to replace them. Diagnosis and treatment remain the responsibility of health professionals.

If you think you may have a medical emergency, call 911 or your local emergency number right away.

3. Who can use Vitaclaris

You must be 18 or older. You're responsible for what you enter in the app, for keeping your device secure, and for keeping backups. You can keep a family profile for someone you care for: your child, or another adult who agreed to it or for whom you can act. Adding one asks you to confirm that. You're responsible for having that right, for what you enter about them, and for what you send to the AI features or share about them. The same goes for importing someone else's records.

Recording a visit: everyone in the room must agree before you record, your doctor included, every time; in many places the law requires it. The app asks you to confirm it before each recording, and offers to tell the visit afterwards instead. You're responsible for having that agreement and for how you use the recording.

Setting up someone's phone: if you set up Simple view on a family member's phone, do it with them and tell them who can see their profile. The Simple view passcode only keeps Simple view from being turned off by accident; it doesn't protect the data on the phone.

4. Your account

You need an account, made with Sign in with Apple, only for Vitaclaris Plus, extra questions, sync, doctor links and shared family profiles. Keep your Apple Account secure: what's done with your Vitaclaris account is your responsibility. You can delete your account at any time in Settings → Account and plan; the Privacy Policy explains what that deletes and what's kept. We may suspend or close an account that breaks these terms (section 9), and we'd tell you why when we can.

5. Vitaclaris Plus, questions and payments

  • What's free: everything in Vitaclaris except the AI features that use Claude. Texts written on your device with Apple Intelligence are free.
  • Vitaclaris Plus is an auto-renewing subscription, monthly or yearly, sold through the App Store. It includes a monthly allowance of questions for the AI features, shown in the app before you buy. A free week may be offered the first time you subscribe: if you don't cancel at least 24 hours before it ends, the subscription starts and is charged.
  • Renewal and cancellation: payment is charged to your Apple Account when you confirm the purchase, or when a free week ends. The subscription renews automatically unless you cancel it at least 24 hours before the end of the current period; the renewal is charged within the 24 hours before it ends. Manage or cancel it in your device's Settings → your name → Subscriptions. Cancelling stops future renewals; you keep Plus until the end of the period you paid for.
  • How questions count: each AI action counts as a number of questions, shown in the app before you use it (for example, a question in Ask is 1, a recorded visit's summary is 3, and reading a document is 5, more for long documents). If an answer fails, nothing is counted. A saved explanation or insight opens again without counting until the information behind it changes. The plan's questions start again each month and don't carry over. Extra questions, bought in packs, never expire and are used after the plan's. AI features used on a family profile count your questions.
  • No cash value: questions are a license to use the AI features in the app. They can't be exchanged for money, transferred or used outside the app, and they end if you delete your account.
  • Refunds are handled by Apple, under Apple's policies. If Apple refunds a purchase, the questions it gave are removed.
  • Fair use: to keep the service working for everyone, the number of requests is limited per minute and per day, and requests can't exceed the sizes the app shows (for example, the number of pages in a document).
  • Changes: we may change what Vitaclaris Plus includes, how many questions an action counts as, or the prices. Price changes for a subscription follow Apple's rules, and Apple tells you before they apply. Questions you've already bought keep their value.

6. How the AI features work

The AI features use Claude, made by Anthropic. When you use one, the app sends what it needs through Vitaclaris's server to Anthropic, which produces the answer, as the Privacy Policy explains; they run only after you allow them in the app. Anthropic's usage policies apply to what's sent: don't use the AI features to create harmful or illegal content. What the AI produces can be incomplete or wrong (section 2). The AI features depend on Anthropic and on our server, and may sometimes be unavailable; when a request fails, it isn't counted.

Some features can write a short text on your device with Apple Intelligence instead. This needs a device, region and language Apple supports, with Apple Intelligence turned on, and Apple's terms apply to it. Each text is checked before it's shown; when one doesn't pass, or Apple Intelligence isn't available, the feature shows its own text or offers Claude, with its cost, for you to choose. These texts are free, count no questions, and can be incomplete or wrong too (section 2).

Explanations can draw on public health information: MedlinePlus and RxNorm from the U.S. National Library of Medicine, and drug labels from the U.S. Food and Drug Administration, which Vitaclaris's server looks up and the app links to. Those organizations don't review Vitaclaris's explanations and aren't responsible for them. This product uses publicly available data from the U.S. National Library of Medicine (NLM), National Institutes of Health, Department of Health and Human Services; NLM is not responsible for the product and does not endorse or recommend this or any other product.

7. Sync and backup

Sync and backup are optional and run only after you turn them on. The app then seals your data on your devices and keeps the sealed copy on Vitaclaris's server, as the Privacy Policy explains, so that the devices you use with your Vitaclaris account have the same data and a new one can get it back.

  • Your recovery key: only one of your devices or your recovery key can open the copy. Keep the key somewhere safe. If you lose every device and the key, nobody can open the copy, us included, and we can't recover it for you.
  • No guarantee: we work to keep sync and backup reliable, but they come as described in section 12: a change can arrive late or not at all, and the copy can be unavailable or lost. Keep backups of your own (Settings → Your data), as section 3 says.
  • Limits: the copy has limits, such as 5 GB of storage per account and 10 devices. Past the storage limit, new photos and documents stay on the device that has them.
  • Changes: we may change or stop sync and backup. If we stop them, we'll tell you in advance; what's on your devices stays there.

Shared family profiles. You can invite people to share a family profile you keep. Everyone you invite can see and change it, and keep what they saw; only you can invite, remove people or delete the profile. Invite only people the person agreed to, or who care for them with you, and remove anyone who shouldn't have it anymore. Sharing has the same limits and no-guarantee as sync.

8. Your content

What you enter, import or add stays yours, on your devices, and we get no rights to it, except what's needed to pass your requests to Anthropic and send back the answers when you use an AI feature, and, when you use sync, doctor links or shared family profiles, to keep their sealed copies and pass them where you send them.

A doctor link lets anyone who has it read your summary until it ends. Share it only with people you trust, and turn it off when it's no longer needed. You decide who gets it, and we can't take back what someone already read or saved.

9. Acceptable use

Don't misuse the app or the server: don't use them to break the law or anyone's rights; don't interfere with how they work; don't get around the question counts, limits or purchases, or use Vitaclaris's AI for anything other than your own use of the app; and don't copy, modify or reverse engineer the app except where the law allows.

10. Beta versions

Test versions shared through TestFlight are unfinished. They can have bugs, lose data or stop working, their features can change or be removed, and they expire under Apple's TestFlight rules. Purchases in TestFlight are tests and aren't charged. Don't rely on a beta as the only copy of important records, and tell us what goes wrong.

11. Other services

Vitaclaris works with services from other companies and organizations, such as Apple Health, Apple Intelligence, Apple Maps, the App Store, Sign in with Apple, iCloud Keychain, Anthropic, Cloudflare, Open Food Facts, MedlinePlus and RxNorm (U.S. National Library of Medicine), openFDA (U.S. Food and Drug Administration), Mail, Messages or WhatsApp, and the portals and apps of the labs you use. Their own terms apply to them, and we're not responsible for them.

12. Disclaimers and limits of liability

As far as the law allows, Vitaclaris, its AI features and sync are provided "as is" and "as available", without warranties of any kind, as the Apple EULA describes. As far as the law allows, we're not liable for indirect, incidental, special or consequential damages, or for lost data, arising from your use of the app, and our total liability is limited as the Apple EULA sets out. Nothing in these terms limits rights that consumer protection laws give you and that can't be waived.

13. Apple

These terms are between you and us, not Apple. Apple isn't responsible for Vitaclaris or its content, has no obligation to provide maintenance or support for it, and isn't responsible for claims about it, including product liability, legal or regulatory compliance, and intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these terms and can enforce them.

14. Changes and ending

We may update the app and these terms. If a change is significant, the app will ask you to agree again before it applies to you. You can stop using Vitaclaris, delete your account and delete the app at any time. We may stop offering Vitaclaris or its AI features; if we stop the AI features while you have a paid subscription, we'll tell you in advance, and refunds are handled by Apple.

15. Governing law and contact

The governing law and venue set out in the Apple EULA apply to these terms too.
